IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING STYLIE, YOU AGREE TO BE BOUND BY THESE TERMS. THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION (SECTION 15) AND CLASS ACTION WAIVER (SECTION 16) THAT REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

These Terms of Service (Terms) govern your access to and use of the Stylie mobile application, website, and related services (collectively, the Service) provided by Stylie Inc. (Stylie, we, our, or us). By creating an account or using the Service, you agree to these Terms and acknowledge that you have read and understood our Privacy Policy.
1. Eligibility and Account Requirements
1.1 Age Requirement
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
1.2 Account Creation and Security
To use certain features of the Service, you must create an account. You agree to: (a) provide accurate and complete information during registration; (b) maintain the security of your account credentials; (c) notify us immediately of any unauthorized access to your account; and (d) accept responsibility for all activities that occur under your account.
You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.
2. Description of the Service
Stylie is an AI-powered fashion styling service that provides personalized outfit advice and shopping recommendations. You can send photos of your daily outfits to our AI chatbot, which will analyze your style and provide feedback, suggestions, and product recommendations.
2.1 Service Limitations
The Service uses artificial intelligence technology, which has inherent limitations:
- AI recommendations may not always be accurate or appropriate for your specific needs
- The Service provides styling advice but does not replace professional fashion consultants
- Product availability and pricing from third-party retailers may change
- AI analysis is based on visual information and may not capture all relevant context
YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY CONTAIN ERRORS OR INACCURACIES. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING THE SUITABILITY OF ANY ADVICE OR RECOMMENDATIONS BEFORE ACTING ON THEM.
3. Your Content and Photos
3.1 Ownership
You retain ownership of all photos, messages, and other content you submit to the Service (User Content). By submitting User Content, you grant Stylie a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content for the following purposes:
- To provide and improve the Service
- To train and improve our AI models (unless you opt out in Privacy Settings)
- For safety and policy enforcement purposes
- As described in our Privacy Policy
3.2 Content Standards and Prohibited Content
You agree not to submit User Content that:
- Contains nudity, sexually explicit material, or inappropriate imagery
- Depicts minors or children under 18 years of age
- Violates any person's intellectual property, privacy, or other rights
- Contains hateful, discriminatory, or harassing content
- Promotes illegal activities or violence
- Contains malware, viruses, or malicious code
We reserve the right to remove any User Content that violates these Terms or our Acceptable Use Policy, and to suspend or terminate accounts that repeatedly violate our content standards.
4. Acceptable Use Policy
When using the Service, you agree not to:
- Violate any applicable laws or regulations
- Infringe on others' intellectual property rights
- Attempt to reverse engineer, decompile, or hack the Service
- Use automated tools (bots, scrapers) to access the Service
- Interfere with the Service's operation or other users' experience
- Impersonate others or misrepresent your identity
- Use the Service for commercial purposes without our permission
- Collect or harvest personal information about other users
- Attempt to gain unauthorized access to other users' accounts
5. Intellectual Property Rights
5.1 Stylie's Intellectual Property
The Service, including all software, algorithms, AI models, text, graphics, logos, and other content (excluding User Content), is owned by Stylie and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission.
5.2 AI-Generated Recommendations
Subject to these Terms, you may use the styling advice and recommendations provided by the Service for your personal, non-commercial use. However, due to the nature of AI technology, similar recommendations may be provided to other users. We do not guarantee that recommendations will be unique to you.
6. Subscription Plans and Payments
6.1 Subscription Plans
Stylie offers both free and paid subscription plans. Paid subscriptions (Premium Plans) provide access to enhanced features.
6.2 Billing and Automatic Renewal
Premium Plans are billed on a recurring basis (monthly or annually, depending on your selection).
YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH BILLING PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. You authorize us to charge your payment method for the applicable subscription fee and any taxes.
6.3 Price Changes
We may change subscription prices at any time. Price changes will apply to your subscription at the start of your next billing period after we provide you with at least 30 days' notice.
6.4 Cancellation and Refunds
You may cancel your Premium Plan at any time through your account settings or by contacting customersupport@getstylie.com. Cancellation will take effect at the end of your current billing period.
YOU WILL NOT RECEIVE A REFUND FOR ANY UNUSED PORTION OF YOUR SUBSCRIPTION, except where required by law.
If you believe you were incorrectly charged, contact us within 30 days for a refund request.
6.5 Free Trials
We may offer free trials of Premium Plans. If you do not cancel before the trial ends, your payment method will be charged for the subscription. Free trial eligibility is determined at our sole discretion and is typically limited to one trial per user.
7. Third-Party Services and Links
The Service may integrate with or link to third-party services, including online retailers, social media platforms, and payment processors. These third parties have their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk. If you make purchases through third-party retailers recommended by Stylie, your transaction is with that retailer, not with us.
8. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data, including the photos you submit to the Service. By using Stylie, you consent to our collection and use of your data as described in the Privacy Policy. You acknowledge that:
- Photos you submit may be analyzed by AI and used to train our models (unless you opt out)
- We implement security measures but cannot guarantee absolute data security
- Your data may be processed in countries outside your location
9. Disclaimers and Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- AI recommendations will be accurate, suitable, or complete
- The Service will meet your specific requirements
- Any defects or errors will be corrected
- Third-party products or services will be available or suitable
STYLIE IS NOT A PROFESSIONAL STYLING SERVICE AND DOES NOT PROVIDE PROFESSIONAL FASHION ADVICE. THE SERVICE IS FOR ENTERTAINMENT AND GENERAL INFORMATIONAL PURPOSES ONLY. YOU ACKNOWLEDGE THAT AI-GENERATED CONTENT MAY BE INACCURATE, INCOMPLETE, OR INAPPROPRIATE FOR YOUR NEEDS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STYLIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or goodwill
- Damages resulting from AI errors or inaccurate recommendations
- Unauthorized access to your account or data
- Third-party products, services, or conduct
- Your reliance on advice or recommendations from the Service
IN NO EVENT SHALL STYLIE'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO STYLIE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify, defend, and hold harmless Stylie and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your User Content or photos
- Your violation of these Terms or applicable law
- Your violation of any third-party rights
- Your negligence or willful misconduct
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting
customersupport@getstylie.com or using the account deletion feature in the message system (text “STOP”). Upon termination, your account and data will be deleted in accordance with our Privacy Policy.
12.2 Termination by Stylie
We may suspend or terminate your account at any time, with or without notice, for any reason, including:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent, abusive, or illegal activity
- Non-payment of subscription fees
- Extended inactivity
- At our sole discretion for business reasons
Termination does not relieve you of payment obligations incurred before termination. Sections of these Terms that by their nature should survive termination will continue to apply.
13. Modifications to Service and Terms
13.1 Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time without liability to you. We will provide reasonable notice of material changes when practicable.
13.2 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
14. Governing Law
These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
15.1 Agreement to Arbitrate
You and Stylie agree to resolve any disputes arising from these Terms or the Service through binding arbitration, except for disputes that may be brought in small claims court. Arbitration uses a neutral arbitrator instead of a judge or jury and is subject to limited review by courts. This means you are waiving your right to a jury trial.
15.2 Arbitration Process
Any arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in the county where you reside or another mutually agreed location. You can obtain AAA rules at www.adr.org.
15.3 Costs of Arbitration
Each party will be responsible for their own attorneys' fees and costs unless the arbitrator awards them.
15.4 Opt-Out Right
You may opt out of this arbitration agreement within 30 days of creating your account by sending written notice to
customersupport@getstylie.com with your name, email, and statement that you opt out of arbitration. Opting out does not affect other provisions of these Terms.
16. Class Action Waiver
YOU AND STYLIE AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any supplemental terms, constitute the entire agreement between you and Stylie regarding the Service.
17.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
17.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
17.5 Force Majeure
We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet disruptions.
